Oui Gruppe GmbH & Co. KG, its subsidiaries and partner companies (hereinafter referred to as ‘Oui Group’) attach great importance to the protection of your personal data and your right to self-determination. The Oui Group collects, processes and uses your personal data during your visit to our online store exclusively in accordance with the principles described below and in compliance with the German Federal Data Protection Act (Bundesdatenschutzgesetz) and the German Broadcast Media Act (Telemediengesetz, TMG).

1 Your Personal Data

Personal data are individual details regarding personal or material affairs that could be used to establish a connection to your person. These include, for example, your name, your telephone number as well as your postal and e-mail addresses.

2 Collection and Use of Your Personal Data

As a basic principle, your personal data will only be collected and used when visiting the Oui Group webpage if you register there or if your visit to the webpage results in a contractual relationship. When visiting the webpage you will be requested at various times to enter personal data. The Oui Group collects or uses this data

to receive and process your order,

for the collection of open accounts receivable,

to receive and process your requests,

in order to check the creditworthiness in case of legitimate interest,

to forward newsletters, if you have consented separately to this.

These points are explained in greater detail below:

a) Use of your personal data in order to receive and process your order

The Oui Group uses your personal data, in particular your name (first name and surname), your address, your telephone number, your e-mail address, your credit card number, your date of birth and your bank account details, which you have provided during the actual purchasing process, if necessary for the purpose of processing and invoicing your order. For processing your order, the Oui Group will pass on your personal data to a logistics service provider employed by the Oui Group. On behalf of the Oui Group the logistics service provider will process your data in compliance with these data protection regulations as well as the necessary safety precautions.

b) Use of your personal data for the collection of open accounts receivable

The Oui Group will furthermore use your personal data, which we have collected and saved for the purposes of receiving and processing your order, to collect open accounts receivable. For this purpose the Oui Group commissions a debt collection company, to which the Oui Group will communicate and allow to process the requisite data in compliance with these data protection regulations as well as with the requisite safety precautions.

c) Use of your personal data for the processing of your requests

The Oui Group will furthermore collect and use your personal data in order to be able to process any suggestions or remarks you have communicated to us, e.g. by means of a contact form on the website.

d) Credit check by the SCHUFA (German General Credit Protection Agency) or other companie

The Oui Group transmits certain information, which you have provided to the Oui Group as part of the ordering procedure, to carefully selected service providers, who will check your creditworthiness. The data transmitted to these companies encompasses your first and surnames, your postal address, your date of birth and your credit card details. These service providers will check the existence of negative attributes regarding your creditworthiness, calculate your credit rating and determine your ‘score’. A ‘score’ predicts the risks of a possible shortfall in payment on the basis of well-known empirical values using a statistical method. At present these service providers are: SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden; Creditreform Rosenheim Karl KG, Oberaustrasse 14, 83026 Rosenheim; and Creditreform Boniversum GmbH, Hellersbergstr. 11, 41460 Neuss.
The Oui Group will also forward data to the companies aforementioned on the basis of non-contractual behaviour, if this is admissible in consideration of all interests concerned. These companies store and transmit the data to their contract partners in the EU internal market in order to provide this information for the evaluation of the creditworthiness of natural individuals. You can obtain information from the SCHUFA or other companies regarding the data stored that relates to you. e) Use of your personal data for the forwarding of newsletters

If you have expressly consented to receive such information, the Oui Group collects and uses your personal data, in particular your name (first and surnames), your address, your e-mail address and your date of birth, to send you further information regarding SET products, special offers, such as birthday mailings or customer surveys as well as general customer information. The information can be provided by e-mail or via traditional postal service.
If the Oui Group has received an e-mail address from you in connection with the order placed in the SET shop, the Oui Group will use this for the direct advertising of its own similar goods or services, unless you have refused such use. Naturally we clearly indicate to you when collecting the e-mail address and upon each use that you have a right of revocation.
For the purpose of sending newsletters, the Oui Group uses specialised service providers, to which the personal data required for this activity are transmitted. These service providers will only process your personal data on behalf of the Oui Group and in accordance to the Oui Group’s instructions. Compliance with these data protection regulations as well as the necessary security measures is guaranteed.

f) Use of your personal data for the statistic analysis of page views and orders

This website uses Google Analytics, a web analysis service provided by Google, Inc. (‘Google’). Google Analytics uses so-called ‘cookies’ (see also no. 4), which are text files placed on your computer, to help the website analyse how you use the site. The data generated by the cookie about your use of the website also includes, for example, your shortened IP address. The shortening of the IP address anonymises the data, i.e. it is no longer possible to identify you as a website visitor. The data anonymised in this way will be transmitted to and stored by Google on servers in the United States of America. Google will use this anonymised data for the purpose of evaluating the use of the website, compiling reports on website activity for the Oui Group as the website operator and providing other services relating to website activity and internet usage. Google may also transfer this anonymised data to third parties when required to do so by law, or where such third parties process the data on Google's behalf. Under no circumstances Google will associate your anonymised IP address with any other data held by Google. Users may refuse the installation of cookies by selecting the appropriate settings on their browser; however, it may no longer be possible to use the full functionality of this website.

g) Use of your personal data for other technical purposes

When you visit our webpages the Oui Group will save the following information as standard

the webpage where you came from,

the date and the duration of your visit
the browser type
your browser settings

your operating system
the page visited by you

The Oui Group uses cookies in order to determine the preferences of visitors and in order to make a tailor-made offer or to design your online visit more comfortably and individually, for example by avoiding the repeated input of data. Please see also number 4 below regarding this topic. Apart from that we only store personal data if you send them to us voluntarily (e.g. by completing online forms).

3 No passing on to third parties

We will not pass on your personal data, in particular your first name and surname, to third parties without your prior consent, unless we are legally obliged to divulge the data, for example when ordered to do so by a public prosecutor or due to a court order. Your personal data is stored and used only in the Federal Republic of Germany.
Should you choose to pay by instant transfer, at no time will your PIN or TAN number be saved or stored.

4 Cookies and automatically transmitted technical information

During the visit to the website, the Oui Group also uses so-called “cookies”. Cookies are small text files on your computer which are saved by your browser on your computer. The Oui Group uses the information contained in the cookies to make your online visit more pleasant and individual and can also use it to manage your virtual shopping cart, for example. In addition, the Oui Group uses cookies to save your individual settings, for example your chosen language, so that you do not need to re-enter these settings each time you visit the site again. The Oui Group stores the following information in encrypted form in the cookies that it sets: an anonymous identifier for your computer and the settings that you have selected on the Oui Group webpage.
Furthermore, the Oui Group uses a number of other automatically transmitted technical information, such as your IP address. Your IP address is saved in a use-specific manner during the payment process in order to protect against fraud. You can also completely disable the use of cookies in the settings of your particular browser program. However, the Oui Group would like to point out that some areas of the webpage may then no longer work or no longer work properly.

6 Usage profiles

Using pseudonyms, the Oui Group creates usage profiles for the purposes of advertising, market research and the improvement of our services. These usage profiles are not merged with the data concerning the bearer of the pseudonym. You can refuse such use of the data.

7 Duration of storage and information about your personal data, updating and deletion

As a matter of principle, the Oui Group will not store your data for any longer than it is necessary for the purposes mentioned in these data protection regulations or for compliance with legally specified archiving or storage obligations. Of course, the Oui Group will inform you by request about whether and what personal data the Oui Group stores concerning you. The Oui Group constantly endeavours to ensure that your data is correct and up-to-date. Nevertheless, if incorrect information should have been stored, please inform the Oui Group so that the Oui Group can correct this immediately.
